AUSTRALIA, Australia – A federal court has ordered an Australian firm to pay $3.5 million to resolve allegations it illegally marketed prescription medicines for erectile dysfunction.
The case is in a case involving a group of men who took part in a class action lawsuit against the drug maker Eli Lilly and Company, alleging they illegally marketed and sold a counterfeit version of Viagra.
The suit, brought by Mr Abbott, a lawyer at New Delhi’s Hims & Byakat LLP, said the firm, which is based in India, purchased the Viagra tablets from a vendor named Apotex, an online pharmacy. The Viagra tablets were intended for men who were not able to take a drug that could help them, and the products included the popular ‘S’ in ‘erectile dysfunction’ (a word used to describe a persistent inability to attain or maintain an erection).
The complaint said Apotex had advertised the tablets in Australia but it did not sell the medication.
Mr Abbott claimed that the online pharmacy had provided the tablets to customers without the knowledge of the Australian government and that the products were counterfeit.
He said the firm had not advertised the medicines or the products’ names.
The lawsuit, which is brought in a state court in New Delhi, said the company had not provided the correct product name and the company’s sales figures. The company had also not offered a sample for the counterfeit tablets.
Mr Abbott said the products were advertised for the use only by men with erectile dysfunction.
Mr Abbott said in a statement that his company was not selling the tablets. “We did not offer an accurate product name and therefore, we do not sell the product,” he said. “The product was not advertised to men and we did not offer to sell the product.”
The suit said the tablets had been seized from the pharmacy’s store in India by an Australian Customs officials.
The suit said the tablets had been tested and found to be ineffective.
Mr Abbott said the products had been found to be contaminated and that his company was not testing the samples.
He added that the company had tested the products “for falsified and counterfeit” samples.
Mr Abbott said that he was the lead plaintiff in the case. “We believe that these products are being sold to the public and that the court ordered them to cease selling the medicines.”
He said that his company had failed to produce adequate warnings about the potential dangers of using certain drugs, such as Viagra and Cialis.
In February, Australia's Health and Safety Authority (HSA) said it had received a complaint from Mr Abbott’s company with a claim of “prohibited sales, sale or promotion” of the medicines.
Mr Abbott said in a statement he had been unable to find any evidence in court that the products were being sold to the public.
The company said the case had been brought against the company by two Australian states – NSW and NSW.
